Services are available to clients in Bangkok and surrounding areas, as well as to expatriates and foreign nationals residing in Thailand.
All advice is provided in the context of Thai civil and family law. We do not advise on the law of other jurisdictions, though we may indicate where complementary expertise should be sought.
4. User Responsibilities
When using our website or engaging our Services, you agree to:
- Provide accurate and complete information to allow us to advise you properly
- Not use the website for any unlawful, fraudulent, or abusive purpose
- Not attempt to access systems or data beyond what is necessary for normal use
- Not copy, reproduce, or redistribute website content without our written permission
5. Intellectual Property
All content on this website — including text, design, layout, and structure — is the property of Wongsakan or its licensors and is protected under applicable Thai copyright law. You may access and view website content for personal, non-commercial use. Reproduction, redistribution, or modification of any content requires our prior written consent. No rights are transferred to you by virtue of using this website.
6. Payment Terms
Service fees are quoted in Thai Baht (THB). All fees are discussed and agreed in writing before any work is commissioned. Payment is due as set out in the engagement letter provided at the commencement of each matter.
Payment methods accepted include bank transfer to our designated account. Details are provided in the engagement letter. Invoices not settled within 14 days of the due date may attract a late payment charge.
Refunds: Initial consultation fees are non-refundable. For ongoing matters, fees for work already completed are non-refundable. If you instruct us to cease work, a final invoice will be raised for any work completed to that point.
7. Service Delivery Terms
Legal timelines are subject to court scheduling, third-party response times, and the complexity of individual matters. Timelines discussed during consultation are estimates only and may change due to circumstances outside our control.
We will notify you of any material change to the scope or timeline of your matter before proceeding. Changes to the agreed scope that affect fees will be documented and agreed with you in writing.
Confidentiality: All information shared in connection with a legal matter is treated as strictly confidential in accordance with our professional obligations and the PDPA.
8. Disclaimers
Content on this website is provided for general information only and does not constitute legal advice. Specific legal advice is only given within a formal client engagement. We make reasonable efforts to ensure website content is accurate and current, but we cannot warrant its completeness or that it reflects the most recent legal position.
Legal outcomes are inherently uncertain. We do not represent or imply that any particular result will follow from engaging our Services. Past matters are no indication of future results.
9. Limitation of Liability
To the extent permitted by Thai law, Wongsakan's liability in connection with services rendered shall not exceed the fees paid by you for the specific matter giving rise to the claim. We shall not be liable for indirect, consequential, or special losses, including loss of business opportunity, even if we have been advised of the possibility of such losses.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any other matter that cannot lawfully be excluded under Thai law.
10. Indemnification
You agree to indemnify and hold harmless Wongsakan, its lawyers, and staff from any claim, loss, or expense — including reasonable legal costs — arising from your breach of these Terms, provision of inaccurate information, or misuse of this website.
11. Termination
Either party may terminate an engagement by giving written notice. Termination does not affect any obligation that arose before the effective date of termination. Any fees for work already completed remain due and payable.
We reserve the right to decline or cease acting for any client where professional obligations or ethical standards so require, subject to providing reasonable notice.
12. Dispute Resolution
These Terms are governed by the laws of Thailand. Any dispute arising from the use of this website or the provision of Services shall first be referred to informal negotiation between the parties. If not resolved within 30 days, disputes may be referred to the Thai Arbitration Institute or to the courts of Bangkok, which shall have exclusive jurisdiction.
13. General Provisions
- Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between the parties.
- Severability: If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
- Waiver: Failure to enforce any provision shall not constitute a waiver of the right to do so in future.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
14. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our website following an update constitutes acceptance. We will make reasonable efforts to communicate material changes directly to active clients.
